Liability Waiver, Acknowledgment of Risks and Conditions of Participation

This document concerns participation in an activity organized or supervised by Jaxsun Sports, operating under company number BE0825.467.030, represented by its manager Mathieu Otjacques.

This waiver must be completed, dated and signed by the adult participant, or by the parent, legal guardian or legal representative for any minor participant.

2. Activities Covered

This waiver applies in particular to the following activities: kitesurfing, wakeboarding, surfing, paddleboarding, snowkiting, board sports, sports coaching, private lessons, camps, equipment rental or provision, as well as any related activity organized or supervised by Jaxsun Sports.

3. Declaration of Physical Fitness

The participant declares that they are in good general health and have no known medical contraindication to the practice of water sports or board sports.

The participant undertakes to inform Jaxsun Sports before the start of the activity of any medical condition, injury, treatment, physical limitation, health issue, allergy or any other element likely to affect their safety or that of other participants.

The participant acknowledges that it is their responsibility to consult a doctor in case of doubt regarding their fitness to participate in the activity.

4. Acknowledgment of Risks

The participant acknowledges that kitesurfing, wakeboarding, surfing, paddleboarding, snowkiting and other board sports involve inherent risks, even when supervised with care and caution.

These risks may result in particular from:

  • weather conditions, wind, waves, currents, tides or temperature;
  • contact with water, ground, equipment, lines, board, boat or other users;
  • the presence of natural or artificial obstacles;
  • the behavior of the participant or third parties;
  • unpredictable movements, falls, errors of judgment or loss of control;
  • practice in a natural or changing sporting environment.

The participant acknowledges that these risks may lead to material damage, minor or serious injuries, temporary or permanent incapacity and, in exceptional cases, risk to life.

5. Participant Commitments

The participant undertakes to:

  • follow the instructions given by Jaxsun Sports, its instructors, supervisors or representatives;
  • not adopt dangerous behavior for themselves, other participants, supervisors or third parties;
  • not participate under the influence of alcohol, drugs or substances affecting vigilance;
  • immediately report any fatigue, pain, discomfort, excessive fear or difficulty;
  • use the equipment in accordance with the instructions received;
  • respect safety rules, priority rules, navigation rules and behavior rules on the spot.

6. Responsibility of Jaxsun Sports

Jaxsun Sports undertakes to implement the reasonable means necessary to organize and supervise activities in suitable conditions, taking into account weather conditions, the participant’s level, available equipment and general safety.

The participant nevertheless acknowledges that Jaxsun Sports cannot guarantee the total absence of risk, nor be held liable for damages resulting from normal, foreseeable or inherent risks related to the practice of the activities concerned.

This waiver is not intended to exclude the liability of Jaxsun Sports in cases of intentional fault, gross negligence, serious breach of an essential obligation or in cases where Belgian law prohibits limitation or exclusion of liability.

7. Personal Responsibility of the Participant

The participant remains responsible for their actions, behavior, personal decisions and compliance with the instructions received.

The participant acknowledges that they may be held personally liable for damage caused to Jaxsun Sports, other participants, third parties, equipment or facilities in case of wrongful, careless, dangerous behavior or failure to comply with instructions.

8. Equipment Provided, Rented or Made Available

The participant acknowledges receiving the equipment in apparent good condition and undertakes to use it with care and in accordance with the instructions provided.

In the event of loss, theft, deterioration or breakage resulting from misuse, negligence, failure to comply with instructions or wrongful behavior, the participant may be required to reimburse all or part of the repair or replacement costs.

9. Weather Conditions, Rescheduling and Absences

Water and board sports activities depend heavily on weather conditions, wind, the participant’s level and scheduling availability.

Jaxsun Sports reserves the right to postpone, adapt, relocate or cancel a session if conditions do not allow proper or suitable practice.

Lessons postponed due to weather or organizational reasons remain valid for a maximum period of one year from the first booking date, unless otherwise agreed in writing.

In case of participant absence, significant delay or late cancellation, the lesson will not automatically be refunded. Rescheduling may only be considered upon presentation of a valid medical certificate or according to written agreement from Jaxsun Sports.

10. Minors

For any minor participant, the parent, guardian or legal representative declares that they have read and understood this waiver and authorize the minor to participate in the activities concerned.

The legal representative confirms that the minor is fit to participate in the activity and undertakes to inform Jaxsun Sports of any relevant medical, physical or behavioral information.

11. Personal Data

The information provided in the context of booking, registration and this waiver is used in order to organize the activity, ensure customer follow-up, adapt equipment, manage safety and comply with the administrative obligations of Jaxsun Sports.

This data is not sold to third parties. It may be retained for the period necessary for the administrative, commercial, insurance or legal management of the activity.

12. Acceptance

The participant declares that they have carefully read this waiver, understood its content, acknowledge the risks related to the activities concerned and accept the conditions of participation.
